He didn't kill him, but he did play a part in it. The exact path to unlocking the Magekyou hasn't exactly been nailed down. Kishi keeps jumping around. First it was to kill your best friend. Then it was to kill anyone who was close to you. The most recent one has just been the death of someone close to you.

But I'd still dis agree with u. Sasuke still would have had the Mangekyou even without the transfer. However, I do believe that his Mangekyou wouldn't hold as much power as it does if Itachi hadn't transfered his techs to him.

Or it could be true that you have to kill the person, and since Itachi knew that he had to weaken Sasuke to the point where Orochimaru would come out (which would leave Sasuke unable to fight), he would have to do something to make sure that the Mangekyo was activated. So Itachi could have had two reasons for transfering his techniques to Sasuke 1) To protect Sasuke from Madara, and 2) To be absolutely sure that Sasuke's Mangekyo would activate.

He wasn't exactly unable to fight after that...but cool.

I can understand to protect Sasuke from Madara, seeing as we've seen that kinda happen, but your #2 point is still going on to the assumption that the transfer alone would awaken Mangekyou.

Death has been involved whenever awakening the Mangekyou. What I believe happened is when Itachi transfered his techs to Sasuke, at the point exactly, Itachi hadn't died yet. Therefore, Sasuke had techs that he couldn't use. Kind of like giving someone a key to a chest that's inside another locked chest; practically useless. But after Itachi died, he awakened Mangekyou, giving him access to those techs and letting him be able to use them. Plus it's not like he could give him those techs after he died; this was the only path of choice.
